


1Hellonetregistered domains are reserved for the sole use of Hellonet, and their Members or Clients.Hellonetreserves the right to edit or remove, any registered domain at their sole discretion, without compromise.
2Hellonet Serversmay only be used for lawful purposes. Illegal or undesirable material will be removed without notice.
3Transmission, distribution and storage of data in violation of global laws, copyright, trademark or other lawful protection - is prohibited.
4User domains containing material deemed, "objectionable" - by Hellonet will be suspended or removed without prejudice. "Adult Content" web sites may be allowed, subject to fee adjustment and/or other conditions imposed by Hellonet.
5Hacking, phreaking, linking, or providing resources aimed at such activities are prohibited. Distribution of material containing viruses, spam, anarchy, or the promotion thereof is forbidden. Compromising the integrity of Hellonet and its Members are deemed unlawful and perpetrators will be prosecuted without notification or warning.
1Unreasonably bandwidth use ofHellonetserver resources will result in increased fees, suspension or termination. Hellonet will be the sole arbitrator of what is considered high usage levels.
2Illegal use ofHellonetservers will result in termination of services. Illegal material is defined as any written content banned under South Africa's Local, Provincial, State or Constitutional laws.
1Be considerate to other users! Internet activities overloading resources, result in reduced efficiency for all users. If in doubt, consult Hellonet for assistance ...
1Hellonet shall take all possible and reasonable steps to protect personal User information recorded for whatever reasons.
2Hellonet may collect and use, personal or company information for Client control record purposes.
3Collected user information will never be disclosed to a third party without users consent. Information may be disclosed to legally authorized parties, if so ordered by due legal process.
4Hellonet hereby claims ownership, and rights to all non-personal, statistical information collected and compiled from user activity during the life of service agreements.

1All Content- Stored on Hellonet Servers and published on the World Wide Web are the property of, or licensed to Hellonet and/or their Clients. Such content are protected from infringement, and abuse by local and international legislation and treaties.
1Users visiting Hellonet domains, or those who electronically contact Hellonet at any time, consent to the reasonable receipt of email and telephonic communication from Hellonet.
1No person, business or web site may link to Hellonet domains without proper, written permission from Hellonet. Refer: Section A - Copyright - Clause 1.1 above.
2Active links to and from Hellonet domains, to Member web sites, are provided as a service. Such links does not confirm that Hellonet agrees, or endorse content found on Client web sites.
1Apart from the provisions of sections 43(5) and 43(6) of the Electronic Communications and Transactions Act; neither Hellonet nor its agents or representatives shall be deemed liable for damage, loss or liability, of whatsoever nature arising from the use - or inability to use - services or content displayed on Hellonet domains and servers. Hellonet offers no warranties that said content are free from errors or omissions. Hellonet offers no warranties that services will be uninterrupted and error free 24/7. Users are encouraged to report malfunctions or errors to Hellonet. Refer: Section A - Copyright - Clause 1.1 above.
2Hellonet websites and services are designed for use by the greater majority. Clients should satisfy themselves, prior to entering into any agreement with Hellonet, whether the available services meets with their requirements, and is compatible with their equipment, and software.
3Information, ideas and opinions expressed on Hellonet domains must not be regarded as professional advice, or as the official opinion of Hellonet.
4Hellonet, their agents or representatives, shall not be liable for damage, loss or liability arising from the use of products sold from any Hellonet domains.
5Hellonet is not directly involved, or contribute in any way, to the provision of Air Time Vouchers sold from their or Client domains. Liability for loss or damages suffered as a result are rejected.
1Cost of products or services may or may not be displayed on Hellonet domains. Alternatively, such cost may be submitted to prospective Clients in writing. Orders placed must be confirmed in writing, and errors should be reported without delay. Refer: Section A - Copyright - Clause 1.1 above.
2Value Added Tax (VAT) will be indicated and added separately on invoices submitted.
3Imported products or services, may incur additional costs due to exchange rate, bank charges and other variations. Such additional costs will be for the Client's account, and will be reflected on invoices submitted upon delivery.
1Product delivery times will be indicated in quotations or on websites. Users will be notified of unexpected delays where applicable.
2Products (other than electronic services) normally require from one to six weeks lead time for delivery within South African borders.
3Website design and construction is dependent on design complexity. Timely provision of content, graphics, and other client input, from Clients - are paramount to maintain quoted completion dates. Hellonet will not accept responsibility for delays unless due to non-performance of Hellonet staff.
4Design of websites, and other software, for clients outside South Africa will be quoted in US Dollars.
1Hellonet operates from the Republic of South Africa, and are subject to its laws and regulations.
2Clients agree that, in the event of a dispute, Hellonet shall not be held liable for legal or professional costs incurred in seeking advice relating to these terms and conditions.
1Persons attempting the delivery of illegal code to Hellonet domains, or Servers. Or those who attempt to gain unauthorized access to pages or domains, shall be prosecuted. Perpetrators shall be sued for damages, losses or subsequent cost of repairs suffered by Hellonet or their clients.
2- Users agree, that login names and passwords shall be protected and applied for personal use only. Users will be liable for damages caused to Hellonet severs through illegal use of access codes made available directly or indirectly to third parties.
1Hellonet may, at its sole discretion, edit, remove from, or add to, these Terms and Conditions of Service - at their sole discretion without prior notice to Clients, Members or Users
1Unresolved disputes arising between Hellonet and users shall be submitted to confidential agreed arbitration. Or through other legal channels.
1Hellonet chooses as its domicilium citandi et executandi, for all purposes under this agreement, whether in respect of court processes, notices, or other documents or communication of whatsoever nature : Muldersbank, Volmoed, Oudtshoorn, Western Cape ...
1Payment to Hellonet for services rendered - may be made by credit card; using globally available service providers, such as "2checkout.com", "Paypal" and others.
The preferred payment methods are by electronic bank transfer or debit order services.
Payments may be made at any bank - in cash or check - subject to the "Additional Charges" clause below. Direct cash or cheque (check) Payments are not accepted, unless agreed to in writing.
1Additional bank charges raised, using any payment method; will be for the client's account.
The current "Additional Charge per transaction" for cash or check deposits are 50.00 ZAR. Add to payment.
2Payments may include additional charges for annual domain registrations, or for additional services provided from time to time. and/or other agreed costs. Services will be activated on receipt of agreed fees; unless alternate arrangements were made beforehand.
1"Monthly" payments are payable in advance, and due in the Hellonet account on the 1st day of each calendar month. New Clients joining Hellonet, are liable for payment for the entire month in which services are activated - Unless otherwise agreed to in writing.
2Payments for "Extended" periods, become due once more - during the last month of the period paid for; On due date as for monthly payments discussed above.
1Cancellation of service - is subject to a one calendar months notice in writing. Such notice must be received prior to the last day, of the previous month. The notice period will commence on the first day of the notice month, and conclude on the last day of the month. Full services will be provided during this - "notice period".
2Transfer will be refused unless all outstanding fees owed to Hellonet have been paid. Transfer may be refused for reasons other than financial. The client will be informed in writing of reasons for refusal.
3Services may be canceled - with or without the luxury of a notice period by Hellonet in cases of abuse, dishonesty, non-payment of fees and other valid reasons. The Clients, in such cases, will still be liable to pay outstanding fees owed to Hellonet before domain transfers will be approved.
1Services not paid 5 days after the "Due Date" - may be suspended as per clause 2 below.
2Services, not paid for on due date, will be suspended - without prejudice. The date of suspension will be determined by Hellonet at their sole discretion, and may be preceded by a final request for immediate payment of arrears. Re-instatement of suspended services will require payment in full of outstanding fees; plus a "reconnection" fee of R250.00, before activation. Continued non-payment of services will result in legal action to recover outstanding fees (plus legal fees where applicable.)
1An "Agreement of Sale" becomes effective on receipt of a deposit, first fee or full payment.
2Refunds of payments made in advance, may be repaid at the discretion of Hellonet. Such refunds will normally be refused if the client was guilty of a misdemeanor, unacceptable conduct as listed on these pages - or for possible non-payment of other or additional services.
1Hellonet defines a domain as: A named or titled space made available to a user on the World Wide Web (WWW) - through registration with various "Registrars" around the world. Such domains are created on the Hellonet servers as the clients chosen Internet Service Provider (ISP).
2Annual Registration fees are payable to registrar's, and will normally be made by Hellonet on behalf of the client. Clients may pay registration fees directly, but are then solely responsible for the maintenance of their domain.
3Hellonet list themselves as the "registrant" of domains registered on behalf of clients, for the first two years, if a free web site is included in the service package. For an explanation of this practice, please contact the Admin Manager. Refer: Tab : Terms - Section A : Copyright : Clause 1.1 above.
16.1This agreement shall be deemed to be in effect - when clients or users, register on any Hellonet domain. The agreement will continue indefinitely until terminated by Hellonet in the event of a breech of contract, or directly by the client or user upon termination of service. Or by either party, for acceptable or legal reason.
